Dencil M. McGrew is suing his physician, Nathan R. Hatfield, because of
injuries he suffered while undergoing a CT-guided biopsy. R. R. Dean Hartley
and Mark R. Staun of Hartley Law Group, PLLC are representing McGrew alongside
an attorney from Blaydes Law.
What Prompted the Filing of the Suit?
In 2019, McGrew had a biopsy of his left renal mass. However, during the
procedure, we believe Dr. Hatfield injured our client’s colon. Before
and during the procedure, the doctor had knowledge that our client’s
colon was very close to his kidney, which presents a risk to the patient.
To protect the colon during the procedure, Dr. Hatfield needed to create
a pocket to separate the kidney and colon. While the doctor did make the
pocket, it likely moved from the intended location, and this migration
presented a risk of freezing injury. However, despite the migration, Dr.
Hatfield continued with the procedure.
Following the procedure, McGrew become ill, and an investigation showed
that he had an abscess where the procedure occurred. He then had to undergo
another operation. For more details concerning the case, you can review
the court documents. The case is being tried in the Cabell Circuit Court
(case number 22-C-100).
Mr. McGrew Is Owed a Duty of Care by His Physicians
In personal injury cases, four elements of negligence must be proven, including
that the defendant owed the plaintiff a duty of care and violated that
duty. We are fighting to prove that Dr. Hatfield acted negligently in
failing to realize the hydrodissection (insertion of the water pocket)
was not a success, and he did not offer our client the standard level
of care, which is a violation of his duty of care to McGrew as a patient.
McGrew is asking for compensatory damages with interest. To stay up-to-date
on the case, you can review the court documents. The case is being tried
in the Cabell Circuit Court (case number 22-C-100).
