Hartley Law Group has filed a medical malpractice complaint on behalf of a West Virginia woman who suffered permanent hearing loss as a result of misdiagnosis by an employee of Davis Medical Center.
The complaint was filed in Kanawha County Circuit Court on October 21, 2026 by Wilda and Peter Lynch. The defendant is Davis Memorial Hospital.
The complaint states that on March 4, 2025, Ms. Lynch presented to Buckhannon Medical Care (a Davis Medical Center facility) for hearing loss in her left ear. Kessa Thorpe, PA-C diagnosed Ms. Thorpe with serous otitis media of the left ear and prescribed her Zithromycin and Flonase. No further testing was done.
Ms. Wilch’s symptoms did not improve after completing the medications and Ms. Thorpe referred Ms. Wilch to an ENT for further testing. The testing revealed moderately severe, sensorineural hearing loss in the left ear. Further evaluation at WVU Medicine showed sudden-onset sensorineural hearing loss. The doctors at WVU noted the best time to treat this type of hearing loss is within 72 hours. By this time, Ms. Wilch had been experiencing hearing loss for about seven weeks.
Ms. Wilch’s hearing loss is believed to be permanent.
The lawsuit targets Davis Medical Center and its corporate entities under the doctrine of vicarious liability, holding them responsible for the actions of their staff, representatives, and contract workers. The case seeks compensatory damages and punitive damages, as well as post-judgment interests, court costs, attorney fees and other relief.
