Hartley Law Group Files Wrongful Death Suit After Hip Surgery

Hartley Law Group has filed a medical malpractice and wrongful death suit in Kanawha Circuit Court regarding the death of 57 year old Cynthia Harman following hip surgery. The complaint alleges that failure to recognize and treat an internal hemorrhage after surgery resulted in her death.

The complaint, filed August 25, 2026 in Kanawha County Circuit Court, was filed by Franklin Harman, as Administrator if the Estate of Cynthia Ellen Harman. The named defendants are Charleston Area Medical Center, Dr. Jason Castle; Dr. Kevin Kimo Koji Souza, Dr. Daniel Miller, Dr. Nathan Remolona; CRNA’s Justin Cole Lyttle and Olivia Michelle Campbell, Comphealth, Independent Healthcare Providers Corp., Qualivis LLC, and General Anesthesia Services Inc.

Ms. Harman was having surgery to remove an infected prosthetic hip implant.  Plaintiff alleges that Charleston Area Medical Center orthopedic surgeon Jason Castle, M.D. injured several pelvic blood vessels during the procedure resulting in substantial blood loss.   It is further alleged that Dr. Castle did not recognize the injuries or request an intraoperative vascular-surgery consultation. She suffered inadequate tissue perforation and hemorrhagic shock which, according to the complaint, was not acted upon in a timely manner in the post-anesthesia care unit, resulting in her death.

The lawsuit targets CAMC and its corporate entities under the doctrine of vicarious liability, holding them responsible for the actions of their staff, representatives, and contract workers. Additionally, the estate contends that the hospital shares direct liability for the failure of its nursing and respiratory care teams to identify and act upon the patient’s deteriorating health. The case seeks compensatory damages and punitive damages against the anesthesia providers, as well as post-judgment interests, court costs, attorney fees and other relief.
